1. Scope of Agreement

2. Services Provided
100patterns provides a Software-as-a-Service (SaaS) platform for financial data analysis, including interactive candlestick charts, drawing tools, and personal watchlists.
Free Version: Provides limited access to data and basic features.
Pro Membership: Provides advanced tools (drawings, notes, export, custom watchlists) and extended data access as described on our pricing page.
3. No Financial Advice
IMPORTANT: The charts, data, and tools provided by 100patterns are for educational and informational purposes only. We do not provide financial, investment, tax, or legal advice. Trading financial instruments involves significant risk. You are solely responsible for your trading decisions. 100patterns is not liable for any financial losses incurred.
4. Account Registration and Security
To use certain features, you must create an account. You agree to provide accurate information and to keep your credentials confidential. You are responsible for all activities occurring under your account.
5. Payments and Subscriptions
Billing: Pro memberships are billed on a recurring basis (monthly or annually).
Price Changes: We reserve the right to adjust pricing. Existing subscribers will be notified in advance.
Refunds: Payments are generally non-refundable except where required by EU consumer law.
6. Right of Withdrawal (EU Consumers)
If you are a consumer located in the European Union, you have the right to withdraw from this contract within 14 days without giving any reason.
Note on Digital Content: By purchasing a Pro Membership and accessing the Pro Features immediately, you explicitly consent to the immediate performance of the contract and acknowledge that you lose your right of withdrawal once the digital content has been accessed.
7. User Conduct & Pro Features
Users are prohibited from:
Circumventing technical restrictions (e.g., attempting to bypass the “Locked Feature” modals).
Using automated systems (bots, scrapers) to extract data.
Sharing Pro accounts with third parties.
8. Limitation of Liability
To the maximum extent permitted by Austrian law, 100patterns shall not be liable for any indirect, incidental, or consequential damages, including loss of profits or data, resulting from the use or inability to use the Service. We do not guarantee 100% uptime or the absolute accuracy of financial data.
9. Intellectual Property
The Service, including the chart engine, code, and design, is the exclusive property of 100patterns. Users retain ownership of their personal notes and drawings but grant us a license to store them for the purpose of providing the Service.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Austria, excluding its conflict of law rules and the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for all disputes arising from or in connection with this contract is the competent court in Vienna, Austria.
